yes the "call" is made by the media not the state, the states do not "call" anything until the ballots are counted.
Jamy unfortunately the absentee, overseas, and military ballots tend to be conservative so it won't change the results of this particular situation.

Ellen should take it to court. It'd get enough publicity that everyone would be forced to actually pay attention and not just sweep her under the rug...

I read that it isn't official for almost a month so some clerks plan to still issue marriage licenses

I do think this will go to the courts.

Does that mean the Supreme Court has final say?

Ok so when I bumped this thread I was unsure of the response, but on a personal note, I just want to say thank you to you ladies for all your kind words on what should be done for equal rights as this is a personal issue for myself and my FI.

Onward, Yes i think the Supreme Court does have the say. Here is the latest on what I have been able to find...

          Here is the latest:

Two law suits have been filed to throw out the Proposition. Also, there is now debate about whether or not the proposition was unconsitutional to begin with and shouldn't have been on the ballot.

I was just talking to my coworker and I had an "A Ha" moment.

I am a believer in things are meant to be...so what if this prop was supposed to pass only to be taken all the way up to the US Supreme Court and mandating that same sex marriages are legal throughout the whole US.

          I mean it could happen!

Yari that is what I was trying to say, I think that this could be the challenge the supreme court needs to make a final decision on this...but remember we don't want it to go to the SC quite yet, we need Obama to put a liberal justice on the court first.

              Good point!

Do anyone of you watch Eli Stone? This totally reminds me of the show...cases going to the Supreme Court.

Here an article about the lawsuit:

Great news. I would loved to see this over turned nation wide. I couldn't believe a few others (Az and FL right?) that had this on the ballot.

Did you see that Ak passed a law permitting unmarried couples from adopting or being foster parents. Geeezz.
