Now, here's the shade of gray tho and why there is a constant addition of definitions to this section of HR law: What is defined as discrimination within classes? The law is vague about what constitutes color, disabilities, etc... Example: A lawsuit could be filed for discriminiation based on physical traits like hair color. Yes, it's extreme, but seriously--- if a company shows negative treatment toward blondes as a whole, then yes a lawsuit can be filed.

But some of it also depends on whether your state is a 'right to work' state. Right to work states really don't have a lot of protection for employees outside of the general discrimination laws.

I would say there's probably something that could defined in the medical category. Especially with documentation. Would your doctor provide a written note excusing you for a recuperation period?

Ugh Heidi, what a bitch. I assume that your work knew what was happening with you, they should cut you some slack. I mean seriously, like your boss didn't know this was a horrendously emotional loss? I hate that whole "call in every day" thing. Shit, you are distraught, you need some time. And then every time you call in, what are you supposed to say "it's Heidi, like I said 2 days ago, I'm not going to be in this week" And then they start asking questions, and then you get more upset, etc, etc. Give them a note from your doctor & be done with it. I totally agree, you should take some more time for healing. This whole episode probably set you back. What a bitch.

I believe this policy is ridiculous as well. I had to call in for 2 weeks. Every day I had to say "This is Rachel. I had emergency surgery to remove my appendix. I won't be in." My benefits specialist that handled my FMLA told me I had to call in EVERY day or my dept. could potentially let me go. They also made me go ask my dr. to offer more specifics about my surgery. Hello- opened abdomen, removed appendix, hospitalized 3 days. What more did they need?

Anways, off topic, but in a round about way- company policies are sometimes asinine. I hope yours will work to benefit you and if they don't, I agree with everyone else. Why work for a place that puts you through this turmoil? I would hope that they would at least have a little bit of vested interest in your well being. And right now, it sounds like they don't.

Heidi... I am so sorry that you are having to deal with such an awful person. You are not over reacting. I cannot believe that someone who works in child care can be so cold about the loss of a baby. It sounds like it is time to find a healthier work environment. Let me know if you need anything.

Heidi, what else can any of us say? The "woman" is using up the air we breathe. What a waste! Honey, if you and Regie can swing it, tell her and the horse she rode in on, to go screw themselves! Compassion is a gift we were given by God. OK, she missed the boat, therefore, she has to answer to someone other than us at another time. She is bad, mean and evil. Do what you have to do, but do not waste any more of your prescious energy on her or the company that she represents. You need to concentrate on Heidi, your, heart and your soul, and yes your womb. Her ugliness and darkness is interferring with your healing. If you can, please walk away and demand every cent that is owed to you! Then, concentrate on what it means to you to be a family with Reggie. You will find the answer, I know you will.

What a fucking bitch? Horrible situation aside, even if you wanted to take off 4 days to get a massage and plan your wedding that is not anyone's business, so tell her to go F*** her self! OMG, I have instant rage for you Heidi! I'd actually enjoy envisioning myself taking your boss's head and ramming it into a wall repeatedly! Over...and over...and over....

My Dr just faxed this letter to me to give to my boss:

 

"Heidi is a patient at our practice. She had a surgical procedure done on 10/5/07/ We advised her to rest @ home until 10/12/07. Please feel free to contact the office should you have any questions or need additional information."

 

Hopefully that gives me my paid time off!!!
