We're being sued.

So a little background. The chiro my dh grew up with told them after they graduated that they should (3 guys) come work for him. So we came out here and it took him forever to get them in. We moved here in April last year. Started working maybe June? Then he drops the bomb shell he's having surgery will be out for like 5 months. Then another he's retiring and selling both practices. Theres 2. One in my DH's hometown where we live and one 20 miles in another town. So my DH goes to some financial advisors and lawyers and one he's selling for a ridiculous amount like half a million bucks and the other for like almost that. Neither are worth that much. So we decide it's too expensive and we'll open our own.

 

Oh and our good friend buys the one in the hometown behind our back! He still hasn't talked to us. Anyways so we go get the loan do all this stuff. In the meantime as soon as we decide DH goes over and tells him. Says you know for me and my family we want to stay in my hometown and this is the best decision. The guy is fine with it. The next day however his wife is in talking trash about my DH. Not to mention the old receptionist decides to work for us b/c she needs stability. So the old DR closes the other office. But through all that he sends a letter saying "Your contract is null and void on March 1" We didn't open till after that date. He wrote it because his deal with our ex-friend was suppose to go through that day but it didn't. Does that matter? Anyways the receptionist at his office (who wants to quit and work for us) is telling this to us.

 

Theres a clause in the contract that we won't open up in a certain distance and use his "Special techniques". But then we have the letter that it's null and void on March 1st. Are there any legal girls on here that can help me out. See this guy used to be nice till he married this word I won't use. As soon as she says something he does it. So I'm pretty sure its her idea. We just so don't need this now. I just quit my job for my mental health! And I can't believe our friend who my DH grew up with has just turned his back on us. He's been treating everyone like crap even his patients! What makes people do that! Anyways this is a total vent. I commend you if you even made it this far. We are just at a loss!

I don't really understand what you are being sued for. For opening up a practice on your own? And if your DH's ex friend is on a disaster mission he will mess that practice up faster than anything and you will get all the patients anyway. If you are being sued for a breach of contract but they sent out a letter saying the contract was void as of March 1 then I don't really see what grounds they have to sue you.

You're exactly right. He's sueing for the breach of contract the non-compete clause. And yes he sent a letter out saying null and void March 1st. We don't understand either. We're calling lawyers and my boss (i just quit) is a paralegal so I'm about to call him. One lawyer said we could counter-sue b/c the wife is talking to patients and calling DH really bad names and such. So she's slandering us. It's really a mess. It's really just a vent right now unless anyone on here is a lawyer/paralegal.

How freakin immature!! And these people are supposed to be DOCTORS? Who specialize in making you pain-free and stress-free?? WTF?? Seriously this sounds like a big crappy mess - so sorry you are going through this, it really doesn't sound like they have much going for them as far as a lawsuit esp. since they sent you that letter.......but then again I am no expert.....good luck girlie!!

I only know English law so thats probs not going to help but I can give you a bit of insight I think!

 

In your DH's contract does it say he cann't work within X amount of miles of the practice should he leave for a certain time? If it does then over here you can't but its arguable. Especially as he's just changed all the terms of the contract, rescinded it and was in effect going to pay off your DH anyway. I'd challenge it but yeah it is going to cost you $.

 

If his cow of a wife is behind it as soon as it starts costing her $ she is going to back down, Slander is also really expensive to sort out but I'd get a Solicitors letter threatening the counter sue. It shouldn't cost you much and it might just frighten them off.

 

As for your m8 i'd go and face him the spinless git, however on the upside if he's being horrible to his clients you are going to get them lol

If your contract is null and void, then how can you be held accountable for anything that's in it after that date? I know NOTHING about the legal side of things, but I just think that common sense would dictate that once the contract is null and void then it doesn't matter what's in the contract... Very weird situation, and his wife sounds like a horrible woman who will get what she deserves because as big3n09 said, Karma IS a motha lol
